Terms of Service (TOS) for DegenWings by TigerBanana LLC

These Terms of Service ("TOS") constitute a legally binding agreement between you and TigerBanana LLC, a limited liability company registered and operating under the laws of the State of Wyoming, United States of America.

They govern your access to and use of DegenWings, our proprietary SaaS software platform designed for automated monitoring and management of cryptocurrency trading activities.

By accessing, registering for, or using DegenWings in any manner, you expressly acknowledge that you have read, understood, and agree to be bound by these TOS.

You further confirm and represent that you are not a U.S. person, U.S. resident, U.S. citizen, green card holder, entity organized under U.S. law, or person located in the United States or any of its territories, and that you assume full, sole, and unconditional responsibility for all actions taken through the platform.

Acceptance of Terms and Operational Consent

Before starting a robot, you must actively check a box confirming "I have read, understood, and agree to the Terms of Service" which constitutes your binding acceptance.

Additionally, before starting the robot, you must confirm your understanding of the operational risks via a mandatory disclaimer.

By checking this box and clicking "Start" you explicitly re-affirm your consent to the following:

"By starting the bot, you confirm that you understand the robot must be paused when opening new positions or moving your assets. Once started, the bot will monitor your account and automatically close positions if they're not market neutral, or if your stop loss, take profit, or funding rate rules trigger. You confirm that you understand trading involves risks and your capital may be subject to losses. You confirm that you have read and accepted our terms of service."

You acknowledge that any action taken by the robot following this activation—including the automatic closing of positions to maintain market neutrality or due to triggered risk rules—is performed based on your explicit instructions and configuration.

TigerBanana LLC is not liable for any financial losses resulting from your failure to pause the robot during manual account activity or for market conditions that trigger your predefined exit rules.

Nature of the Service

DegenWings is exclusively a software tool—a non-custodial, algorithmic platform that enables users to connect their own cryptocurrency exchange accounts via user-supplied API keys for the purpose of monitoring positions and executing automated actions based solely on parameters predefined by the user.

We do not provide any form of financial, investment, or trading advice or recommendations.

We do not manage, hold, control, access, or take any profit from user funds or assets at any time.

We do not guarantee any profits, returns, or performance outcomes.

We do not engage in mining activities.

DegenWings is not a wallet, nor is it a custodial service of any kind.

We do not open, execute, or initiate trades on behalf of users.

Every single action performed by the DegenWings robot —such as closing positions— is triggered exclusively by the user through their individually configured settings and instructions, with no intervention or decision-making by TigerBanana LLC.

Third-Party Trademarks and Materials

DegenWings may display logos, screenshots, and other publicly available materials from supported third-party cryptocurrency exchanges, such as KuCoin and Bybit, solely for illustrative, educational, and informational purposes to demonstrate API integration compatibility and platform functionality.

These materials are used under fair use principles and do not imply endorsement, sponsorship, affiliation, partnership, or approval by such third parties.

TigerBanana LLC claims no ownership, license, or rights in these third-party marks or materials beyond what is permitted by applicable law for non-commercial, transformative reference.

You acknowledge that all actions via DegenWings are your sole responsibility and unaffiliated with any exchange.

TigerBanana LLC disclaims any liability for third-party claims arising from such displays, and you agree to indemnify us against any related disputes.

Geographic Exclusions and Eligibility

DegenWings is strictly not offered, available, or intended for use by any U.S. person, U.S. resident, U.S. citizen, green card holder, entity organized under the laws of the United States, or any person physically located within the United States or any of its territories, possessions, or jurisdictions, including but not limited to Puerto Rico, Guam, the U.S. Virgin Islands, American Samoa, the Northern Mariana Islands, and the United States Minor Outlying Islands.

This restriction is imposed to ensure compliance with applicable laws, regulations, and regulatory requirements. Any person or entity falling within the above categories is prohibited from accessing or using DegenWings.

Any attempt to access or use the service from these prohibited jurisdictions is expressly forbidden and constitutes a material breach of these TOS.

Users who access the service from such areas do so entirely at their own risk and accept full liability for any regulatory violations.

Trading Risks and User Responsibility

Participation in cryptocurrency trading inherently carries substantial risks, including but not limited to the complete loss of invested capital due to extreme market volatility, flash crashes, liquidity issues, exchange failures, API latency, high slippage, or execution failures caused by third-party exchange instability or downtime.

While DegenWings incorporates sophisticated risk management features designed to help users enforce their predefined controls (such as stop-loss, take-profit, market neutrality checks, and funding rate exits), we make absolutely no guarantees or warranties regarding the prevention of losses, the accuracy or timeliness of executions, or the overall effectiveness of the software in any market conditions.

You, the user, are solely and entirely responsible for all actions, decisions, configurations, errors, omissions, and consequences arising from your use of DegenWings.

This includes any financial losses incurred, regardless of cause.

No refunds, reimbursements, or compensations will be provided for user errors, poor choices, market outcomes, or any other results of your trading activities.

Furthermore, the "Market View", "Risky Markets" and "Arbitrage" sections of the platform aggregate and display publicly available data sourced from online third-party providers;

this information is provided for informational purposes only and does not constitute, nor should it be construed as, investment advice, analysis, or recommendations.

API Keys Security and User Obligations

To utilize DegenWings, you must provide your own API keys from supported cryptocurrency exchanges.

Critically, these API keys are never stored, hosted, or processed on the DegenWings public webserver.

In the event of a hypothetical security breach of our website infrastructure, these keys remain inaccessible to any unauthorized party.

Instead, your API keys are securely encrypted and utilized exclusively on the isolated, dedicated server instance running your personal DegenWings robot.

It is your sole responsibility to configure these API keys with the most restrictive permissions possible—specifically, enabling trading functions only and explicitly disabling any withdrawal or transfer capabilities.

Even in highly improbable scenarios where an attacker somehow identifies your robot server, successfully breaches it, and decrypts the keys, they would still be unable to withdraw or misappropriate your funds due to these limited permissions.

While we implement industry-standard security measures to protect your data and operations, no system is impenetrable, and TigerBanana LLC disclaims all liability for any security breaches, data losses, or unauthorized access beyond what is explicitly stated herein.

Liability Limitations and Disclaimers

TigerBanana LLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, data loss, service interruptions, trading losses, or any other harms arising from or related to your use of DegenWings.

The service is provided strictly "as is" and "as available," without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

This limitation applies to the fullest extent permitted by law.

Refund Policy

All sales are final. TigerBanana LLC does not issue refunds for buyer's remorse, impulsive decisions, or changes of mind once a payment has been completed. Completing a payment constitutes your explicit confirmation that you desire the service and accept these terms.

Refunds are strictly limited to technical payment errors under the following circumstances:

(i) if you send a payment exceeding the required amount, you may request a refund for the excess balance;

(ii) if you mistakenly purchase a higher plan (e.g., purchasing a Premium subscription instead of Standard), you may request a refund for the price difference, which will result in an immediate downgrade to the intended tier.

By purchasing a DegenWings subscription, you explicitly acknowledge and agree that trading carries inherent financial risks. TigerBanana LLC, its owners, and its affiliates assume no responsibility or liability for your trading decisions, execution results, or financial losses. Your trading performance remains entirely your sole responsibility.

If you are uncertain about making a purchase, you may request an extension of your trial period before subscribing. The decision to grant or deny any trial extension remains strictly at the sole discretion of TigerBanana LLC.

Referral Program

DegenWings may offer a referral program through which eligible users can receive rewards for referring new customers to the Platform (the "Referral Program").

By participating in the Referral Program, you agree to the terms set forth in this section.

When a new user purchases a paid DegenWings subscription after using a valid referral link or referral code belonging to an eligible participant, the referring user may receive a referral reward equal to 10% of the subscription amount actually received by TigerBanana LLC, subject to the terms and conditions set forth herein.

The referral reward is attributed only when the new customer has been successfully identified by the DegenWings referral tracking system as having used the referring user's referral link or referral code before completing the qualifying subscription purchase.

Referral rewards are calculated on subscription payments actually received by TigerBanana LLC. No referral reward will be earned or paid in connection with a transaction that is subsequently refunded, reversed, charged back, cancelled, or otherwise not retained by TigerBanana LLC.

Referral rewards are processed on a monthly basis and are paid in USDT on the Polygon network to the cryptocurrency wallet address provided by the referring user. There is no minimum payout threshold.

The user is solely responsible for providing a correct and compatible wallet address and for ensuring that the wallet supports USDT on the Polygon network. TigerBanana LLC is not responsible for losses resulting from an incorrect, incompatible, or otherwise invalid wallet address supplied by the user.

Referral rewards do not constitute payment for professional, consulting, marketing, advertising, employment, agency, or other services provided to TigerBanana LLC. Participation in the Referral Program does not create an employment relationship, agency relationship, partnership, joint venture, or independent contractor relationship between the user and TigerBanana LLC.

Users may not refer themselves, create or use multiple accounts for the purpose of generating referral rewards, manipulate the referral system, or engage in any fraudulent, deceptive, abusive, or otherwise prohibited activity.

TigerBanana LLC may withhold, reverse, or cancel referral rewards that are determined to have resulted from fraud, abuse, self-referral, technical manipulation, chargebacks, refunds, or violations of these TOS.

TigerBanana LLC may modify, suspend, or discontinue the Referral Program at any time. Changes to the Referral Program will not affect referral rewards that have already been validly earned prior to the effective date of the applicable change, except where such rewards are subsequently invalidated due to refunds, chargebacks, fraud, abuse, or violation of these TOS.

Participation in the Referral Program is subject to all applicable laws and regulations. Each participant is solely responsible for determining and fulfilling any tax, reporting, or other legal obligations arising from referral rewards received through the Referral Program.

TigerBanana LLC reserves the right to determine, in its reasonable discretion, whether a referral has been validly attributed and whether a referral reward is payable based on the records of the DegenWings referral tracking system.

Governing Law, Disputes, Changes, and Termination

These TOS shall be governed exclusively by the laws of the State of Wyoming, USA, without regard to conflict of law principles.

Any disputes arising hereunder shall be resolved through binding arbitration in Wyoming under the rules of the American Arbitration Association.

We reserve the right to modify these TOS at any time.

Changes will be posted on the platform and emailed to registered users.

They will become effective on the date specified.

We may require re-confirmation via checkbox before robot startup.

We may suspend or terminate your access to DegenWings immediately and without notice for any violation of these terms or at our sole discretion.
